1. Seller and acceptance
PreTrip is provided by Kp Mechanical ("we", "us"). You are contracting with Kp Mechanical for use of the service. By accessing or continuing to use PreTrip, you agree to these terms. If you use it on behalf of a company, you must have authority to bind that company; individual users must be of legal age to agree to these terms.
2. Service and company access
PreTrip provides digital vehicle pre-trip checklists, inspection records, edit history, shareable PDF exports and optional AI photo checks. A company subscription costs NZ$99 plus GST per month and covers that company's drivers and managers. Records are accessible only within the company using its company code. Personal PINs authorise edits and manager actions, which are recorded with the editor's name. Keep company codes and PINs confidential and provide accurate information. We grant a limited, non-exclusive, non-transferable licence to use the service within your subscription.
3. Payments, renewal and cancellation
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Subscriptions renew monthly until cancelled. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Cancel through Paddle; access continues until the end of the paid period. When payment fails, access continues during Paddle's payment-retry grace period. Refund requests follow our Refund Policy.
4. Acceptable use
You must not use PreTrip unlawfully, for fraud or spam, or to infringe intellectual property or privacy rights. Do not upload malware, probe or interfere with security, scrape the service, circumvent limits, reverse engineer it, or resell access without permission. Do not use AI features to generate illegal content, deceptive deepfakes, hate speech, malware or other harmful material, or attempt to bypass model safeguards or jailbreak the system.
5. Intellectual property and your content
Kp Mechanical retains ownership of PreTrip and its intellectual property, including software, documentation and branding. You retain any rights you hold in inspection data, photos and other inputs, and grant us a limited licence to host and process them solely to provide and secure the service. You must have the rights and permissions needed to submit that content. To the extent permitted by law and applicable third-party rights, you may use AI outputs; outputs may not be unique or eligible for intellectual property protection.
Rights holders can report suspected infringement to Kp Mechanical using the contact details supplied with their company subscription, or ask their company manager to relay the complaint. Identify the content, the rights involved and how we can contact you. We may remove or restrict infringing content and suspend or terminate accounts for repeated infringement.
6. AI and vehicle safety
You are responsible for your prompts, input content, verifying outputs and how you use them. AI photo checks only assess visible details and may miss defects, misidentify issues or recommend incorrect actions. They do not certify roadworthiness or replace a physical inspection, a qualified mechanic or regulated professional advice with appropriate oversight. Drivers and managers remain responsible for vehicle safety and compliance. We may moderate or remove content, refuse or filter outputs, restrict AI use or suspend access to enforce these terms.
7. Availability and liability
We do not guarantee uninterrupted or error-free performance. To the extent allowed by law, the service is provided as available without implied warranties of merchantability or fitness for a particular purpose. Nothing in these terms excludes any consumer right, remedy or liability that cannot lawfully be excluded, including under applicable New Zealand law. Keep copies of important inspection records and do not rely solely on PreTrip to make safety-critical decisions.
8. Suspension and termination
We may suspend or terminate access for material breach, non-payment after the retry period, security or fraud risk, or repeated or serious policy violations, including infringement. Cancellation ends access at the end of the paid period. Download records while you have access; ending access does not automatically delete records or audit history, which are handled under our Privacy Notice.
9. Changes and contact
We may update these terms and will notify affected companies of material changes before they take effect. These terms are governed by New Zealand law, subject to mandatory rights under applicable law. For service questions or rights-holder complaints, contact Kp Mechanical using the contact details supplied with your company subscription, or ask your company manager to contact us on your behalf.
